Terms of Service

1. Acceptance of terms

By accessing or using LinkWhale you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service.

2. Description of the service

LinkWhale is a read-only analytics tool that reads data from your Fanvue account (via Fanvue's official OAuth) to provide link attribution, revenue, subscriber, and churn analytics. LinkWhale does not post, message, or modify anything on your Fanvue account. LinkWhale is an independent product and is not affiliated with Fanvue Ltd. "Fanvue" is used only to describe interoperability.

3. Eligibility & accounts

You must be at least 18 years old and have an active Fanvue creator (or agency) account that you are authorized to connect. You are responsible for maintaining the security of your login and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to:

• use the service unlawfully or in violation of Fanvue's own terms;
• attempt to access data belonging to other users, or probe, scan, or circumvent our security;
• reverse-engineer, resell, or misrepresent the service, or use it to build a competing product;
• upload malware or interfere with the integrity or performance of the service.

5. Subscriptions & billing

LinkWhale is a paid product; access requires an active paid plan. Subscriptions are billed through Fanvue Payments as part of the Fanvue App Store. There is no free tier; access requires an active paid plan. Prices are shown at the point of purchase. Billing, renewals, cancellations, and refunds are handled through Fanvue in accordance with Fanvue's terms; cancelling stops future renewals and access ends at the close of the paid period.

6. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Analytics are provided for informational purposes only and depend on the data made available by Fanvue; we do not warrant that figures are error-free, complete, or suitable for any financial, tax, or business decision.

7. Limitation of liability

To the maximum extent permitted by law, LinkWhale will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of (or inability to use) the service. Our total aggregate liability for any claim will not exceed the amount you paid to LinkWhale in the three months preceding the claim.

8. Termination

You may stop using the service and delete your account and data at any time from the dashboard account area, or by emailing support@linkwhale.app. We may suspend or terminate access if you breach these Terms or to protect the service or other users. On termination, your right to use the service ends and your data is deleted as described in the Privacy Policy.

9. Changes to these terms

We may update these Terms as the product evolves. Material changes will be posted here with a new "Last updated" date; continued use after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which LinkWhale is established, without regard to conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute.
